Myth: The use of KIBOR as a benchmark makes the transaction unislamic.

Fact:

Let us take the example of a beverage market: there are many alcohol providers in this market and they all charge 10% rate of profit for all their drinks. Now, another person moves into this market and wants to sell orange juice. He has also decided that he would charge 10% profit for his drink to remain competitive and provide consumers an alternate to alcoholic beverages. Would you consider his orange juice unlawful or haram just because he has charged the same rate of profit? This example clearly illustrates that it is not unlawful from a Shariah perspective to use KIBOR for determining profit. One of the challenges faced by the Islamic banks is that their market is relatively small that they are not in a position to set their benchmark rate. They are the new market entrants, just like the orange juice seller in our beverage example, and they have to keep their pricing competitive to attract the customers of the conventional banking system. Therefore, Islamic banks are using the conventional bank's benchmark, known as KIBOR. However, it is necessary for Islamic banks to adhere to all relevant Shariah conditions while conducting transactions such as buying, selling, leasing, etc. Therefore, using KIBOR as a benchmark for determining profit does not make the transactions of Islamic banks as permissible or impermissible, as long as Islamic banks are fulfilling all the conditions of buying, selling, leasing, etc. according to Sharia.

حقیقت :

آئیے مشروب کی مارکیٹ کی مثال لیتے ہیں: اس مارکیٹ میں بہت سے شراب فراہم کرنے والے ہیں اور وہ سب اپنے مشروبات پر 10% منافع کی شرح وصول کرتے ہیں۔ اب، ایک اور شخص اس مارکیٹ میں آتا ہے اور نارنجی کا جوس بیچنا چاہتا ہے۔ اس نے بھی فیصلہ کیا ہے کہ وہ اپنے مشروب پر 10% منافع چارج کرے گا تاکہ مسابقتی رہ سکے اور صارفین کو شراب کا متبادل فراہم کر سکے۔ کیا آپ اس کی نارنجی کے جوس کو صرف اس وجہ سے حرام یا غیر قانونی سمجھیں گے کہ اس نے بھی وہی منافع کی شرح رکھی ہے؟ یہ مثال واضح طور پر یہ ظاہر کرتی ہے کہ شرعی نقطہ نظر سے (کايبور) کو منافع طے کرنے کے لیے استعمال کرنا غیر قانونی نہیں ہے۔

 

اسلامی بینکوں کے سامنے ایک چیلنج یہ ہے کہ ان کی مارکیٹ نسبتاً چھوٹی ہے، جس کی وجہ سے وہ اپنی بیچ مارک شرح مقرر کرنے کی پوزیشن میں نہیں ہیں۔ وہ ہمارے مشروب کی مثال میں نارنجی کا جوس بیچنے والے کی طرح مارکیٹ میں نۓداخل ہوۓ ہیں اور انہیں روایتی بینکاری نظام کے صارفین کو اپنی طرف متوجہ کرنے کے لیے قیمتوں کو مسابقتی رکھنا ہوگا۔ اس لیے، اسلامی بینک (کايبور) کو بطور بیچ مارک استعمال کر رہے ہیں۔

 

تاہم، اسلامی بینکوں کے لیے یہ ضروری ہے کہ وہ خرید، فروخت، لیزنگ وغیرہ جیسی تمام متعلقہ شرعی شرائط پر عمل کریں۔ اس لیے، منافع طے کرنے کے لیے، (کايبور) بیچ مارک کے طور پر استعمال کرنا اسلامی بینکوں کے لین دین کو جائز یا ناجائز نہیں بناتا، جب تک کہ اسلامی بینک خرید، فروخت، لیزنگ وغیرہ کی تمام شرائط کے مطابق عمل کر رہے ہوں۔
